States of Vitality is an organisational-assessment tool, operated by Mutomorro. These terms explain the basis on which you may use this website and the indicative quote it offers. By using the site, you agree to them. We have tried to keep them short and in plain language.
What States of Vitality is
States of Vitality is a diagnostic service for organisations. We run a short, anonymous survey across your workforce and turn the results into an interactive dashboard that helps you see how your organisation is doing. The website describes the service and lets you request an indicative quote or get in touch.
Using this website
You are welcome to read, share and use the information here for your own purposes. Please do not misuse the site - for example by trying to disrupt it, gain unauthorised access to any part of it, scrape it at scale, or use it in a way that breaks the law. The information on the public pages is for general guidance about the service, not professional advice.
Quotes and pricing
The figure produced by our quote tool, and any pricing in our overview or on the site, is indicative. It is there to give you a realistic sense of cost - it is not a binding offer or a contract. We confirm the exact scope and price with you in writing before any work begins. Prices are in pounds sterling and exclude VAT unless we say otherwise.
Engagements and agreements
When you decide to go ahead, the work itself is governed by a separate written agreement between your organisation and Mutomorro, which sets out the scope, timing, price and terms for that engagement. If anything in that agreement differs from these website terms, the agreement is what applies to the work.
Your data and privacy
How we handle the information you give us through this website is explained in our privacy and cookie policy. For a paid engagement, survey responses from your people are handled under the data protection terms in your agreement: you remain responsible for your workforce's data as the controller, we act on your instructions in providing the service, and responses are treated as confidential and held securely.
Intellectual property
The States of Vitality platform, survey design, dashboard, written content and brand belong to Mutomorro and are protected by intellectual property law. When we deliver results to you, you and your organisation may use them freely for your own internal purposes. The responses your people give, and the data you collect through the service, remain yours.
Availability
We work hard to keep the website and dashboard available and working well, but we provide them on an "as is" and "as available" basis. We cannot promise the site will always be uninterrupted or error-free, and we may update, change or withdraw parts of it from time to time.
Our responsibility to you
States of Vitality gives you insight to inform your own decisions - it does not replace professional legal, financial, medical or HR advice, and you remain responsible for the decisions you take. We do not limit our liability for anything that cannot be limited under the law, such as death or personal injury caused by our negligence, or fraud. Beyond that, and to the extent the law allows, we are not liable for indirect or consequential losses arising from your use of this website.

Where we link to other websites, such as Mutomorro, we do so to be helpful. We are not responsible for the content or practices of sites we do not run.
Changes to these terms
We may update these terms as the service develops. The date at the top shows when they last changed, and continuing to use the site means you accept the current version.
Governing law
These terms are governed by the law of England and Wales, and any dispute relating to them will be subject to the courts of England and Wales.
